Title: The Origins of the Constitutional thought in Contemporary Democratic Regimes

Abstract:

Governing the regimes of contemporary democratic or first world countries, constitutions indicate the rights and freedoms of citizens and the authorities that are exercised within the scope of the state for the protection, concern and development of these rights and freedoms. On the other hand, the constitutions which govern these regimes were not written or invented by specialists or jurists, but developed over centuries. They eliminate absolutism on the basis of thought made by the jurist and believed by nations. These rules have been developed in a balanced manner the relationship between the ruler and the ruled with respect to constitutional articles.

Therefore, there was the price for people to get what they wanted – bloodshed and suffering that cannot be described. Arab countries took the same idea of constitution and articles from the countries described as first world, without knowing how that development took place or the elements and conditions provided in the countries of those constitutions. In order to achieve the aims that were founded at every stage of development, we arrived at two systems that dominate the world, namely the parliamentary system and the presidential system, with the foundations and conditions of each of them. The presidential system is based on dual authority but has failed in most developing countries, including Arab countries, which adopted the presidential system because of non-observance of this duality. Also discussed was how the parliamentary system can achieve better results if the conditions and obligations of authority on which the system is based are taken into consideration.
